The terms that govern projectswitch.co and VIP reservations.
These Terms of Service (“Terms”) govern your use of projectswitch.co (the “Site”) and any reservation you place through it. The Site is operated by Project Switch LLC (“SW/TCH,” “we,” “us”). By using the Site or placing a reservation, you agree to these Terms. If you do not agree, do not use the Site.
1. What this site is
SW/TCH is a pre-launch product. The Site describes a modular trekking pole system that is still in development and lets you join a mailing list or place a refundable reservation ahead of a planned crowdfunding campaign. Nothing on the Site is an offer to sell a finished product, and no product ships from this Site.
2. Product information and imagery
Product descriptions, specifications, prices, timelines and images on the Site describe the product as designed and may change before launch. Some images are computer-generated renderings or AI-assisted concept scenes built from our design files rather than photographs of finished units. Performance figures are engineering targets unless expressly described as test results. We will publish tested figures when we have them.
3. Free list and communications
Joining the free list requires an email address. It carries no cost and no obligation. You may unsubscribe at any time using the link in any email we send.
By joining the list or reserving, you agree to receive email from us about the product, the campaign and your reservation. You can opt out of marketing email at any time. We may still send you transactional messages about a reservation you hold.
4. VIP reservations
What it is. A VIP reservation is a refundable deposit of ten US dollars ($10) that reserves a place in our first production run and locks a discount of thirty-three percent (33%) off the manufacturer’s suggested retail price of the kit you choose when our crowdfunding campaign opens.
What it is not. A reservation is not a purchase of a product, does not create a contract for the sale of goods, and does not guarantee that the product will be manufactured or delivered. You will pay for your kit, at the discounted price, through the campaign platform when the campaign opens.
Refunds. A reservation deposit is fully refundable at any time before the campaign ends. Request a refund by emailing hello@projectswitch.co from the address you reserved with. Refunds are returned to the original payment method. If the campaign does not launch, or launches and is not funded, all reservation deposits will be refunded.
Limits. Reservations are limited in number. One reservation per email address. The discount is tied to the email address used at checkout and is not transferable.
How the deposit is applied. The deposit is separate from the campaign purchase and is refunded or credited as described in the campaign, at our election, once you complete your campaign pledge.
5. Payments and the crowdfunding campaign
Payments are processed by Stripe. We do not receive or store your full card number. Stripe’s own terms and privacy policy apply to the payment transaction.
Our campaign will run on a third-party crowdfunding platform under that platform’s terms. Pledges made there are governed by the platform’s rules, not these Terms. Delivery estimates given during the campaign are estimates.
6. Acceptable use and intellectual property
Do not use the Site to do anything unlawful, to interfere with the Site, to scrape it, or to impersonate anyone. We may suspend access for misuse.
The Site, its content, our marks (including “SW/TCH” and “Project Switch”) and the product designs shown are owned by Project Switch LLC or its licensors and are protected by law. You may not copy, reproduce or create derivative works from them without our written permission.
7. Disclaimers and limitation of liability
The Site is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site and the pre-launch product information on it.
To the fullest extent permitted by law, Project Switch LLC will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or a reservation. Our total liability to you for any claim relating to the Site or a reservation will not exceed the amount of your reservation deposit.
8. Changes, governing law and contact
We may update these Terms. The effective date at the top of this page will change when we do, and material changes to reservation terms will be emailed to reservation holders.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in King County, Washington.
